third party lists were originally compiled to

operate. Affiliate shall ensure that all third
party lists used by or on behalf of Affiliate
were collected by the third party source in
accordance with the same standards listed above,
and Affiliate must create a new emailing list
when there is a substantive change in either the
subject matter or frequency of messages. A
notification about the new emailing list may be
appropriate on the existing emailing list, but
existing subscribers should never be subscribed
automatically to the new list.

CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST
DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE
DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR
USE OF THE SITE OR ANY OTHER MATERIALS OR
SERVICES PROVIDED TO YOU BY COMPANY. THIS
LIMITATION SHALL APPLY REGARDLESS OF WHETHER THE

ADDITIONALLY, OUR MAXIMUM LIABILITY TO YOU UNDER
ALL CIRCUMSTANCES WILL BE EQUAL TO THE AGGREGATE
PRICE YOU PAY FOR Razoreye Media OVER THE COURSE
OF YOUR USE OF THE SITES. THE NEGATION OF DAMAGES
SET FORTH ABOVE IS A FUNDAMENTAL ELEMENT OF THE
BASIS OF THE BARGAIN BETWEEN US AND YOU. THIS
SITES AND THE INFORMATION WOULD NOT BE PROVIDED
WITHOUT SUCH LIMITATIONS. NO ADVICE OR
INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY
YOU FROM US THROUGH THE SITES SHALL CREATE ANY
WARRANTY, REPRESENTATION OR GUARANTEE NOT
EXPRESSLY STATED IN THIS AGREEMENT.
